Giggle v Tickle Appeal in the Federal Court

There has been an explosive twist in Australia’s ‘what is a woman’ trans battle as Harry Potter author JK Rowling gets involved in the debate. Roxanne Tickle, a male who identifies as female, is cross-appealing Sall Grover’s appeal in the federal court. Tickle won his case against Grover last year being awarded $10,000 for indirect discrimination as well as costs. Sall has appealed the decision after Justice Bromwich falsely stated, ‘sex is changeable’. Sex is not changeable; it is a biological reality written on every cell in the human body. Changing facts on a piece of paper does not change that reality. Sall, is the owner of Giggle for Girls, a female-only app that Tickle was excluded from because he is male. He won the case but is not satisfied and wants the verdict upgraded to ‘direct’ discrimination and a greater payout. Ms Tickle had identified as a woman since 2017, undergoing surgery two years later and getting a new birth certificate that lists her sex as female.

Justice Robert Bromwich found Ms Tickle had suffered indirect discrimination, ordering Ms Grover to pay $10,000 in damages – a small fraction of the $200,000 that was being sought – and to cover legal costs. The ‘Tickle vs Giggle’ case made global headlines because it is one of the first times the vexed question of ‘what is a woman’ has been tested in the courts, with the judge sensationally ruling that ‘sex is changeable’. Ms Grover, 40, is appealing the case, having previously said she was prepared to go all the way to the High Court. Harry Potter author JK Rowling has recently posted her whole-hearted support for Sall and the two plan to meet up soon in the UK.
